Probation for spouse assault
Published: July 08, 2008 5:00 PMHitting his common-law spouse in front of police Sept. 8 earned six months probation for Kerry Melvin Heath, 43, of Port McNeill.
Defense lawyer Paul Grier said “the incident was fueled by alcohol on both sides.”
Thefts get probation
Trying to defraud Wal-Mart in Port Alberni of more than $800 in March earned six months of probation for Port Hardy woman Lana T. Wilson.
“The woman took an item without paying three times and then returned it for a refund,” said Crown counsel Jackie Gaudet. “She was caught on video tape.”
Defense lawyer Paul Grier called it an “unfortunate incident,” not likely to be repeated, because Wilson is living with family in Port Hardy, has attended Narcotics Anonymous, and has just landed a job as a cook in a camp at Rivers Inlet.
Assault gets fine
A female youth who punched her best friend Nov. 6 was fined $100, June 24 in court.
The friend was walking with a young man when the youth came out of Stink Creek Park and started yelling at her, Crown counsel Jackie Gaudet said. Eventually one punch was delivered.
The same youth was placed on a peace bond when she intervened between two sisters and got overly physical with one.
Passed out costs
Sleeping in the driver’s seat while he sobered earned Port Alice man James Alan Rail a $600 fine and one year driving ban.
Port Alice RCMP were called to investigate a man passed out in the driver’s seat of a vehicle on Marine Drive, said Crown counsel Dawana St. Germain.
“He said he had no intention of driving, but the engine was running,” said St. Germain.
Disturbance noted
Causing a disturbance by fighting and yelling outside a residence in Port McNeill last year earned Corey K. Trevors a year of probation, June 25 in court. Trevors was originally charged with three assaults, which he denied in court. Circumstances were not read into the record by Crown counsel Dawana St. Germain.
Fine for breach
Telephoning a woman he was accused of assaulting, and ordered to stay away from while his case proceeded, earned former Sointula man Nicholas Hawkins a $200 fine, June 26 in court. The assault charge against Hawkins was stayed when he admitted the other.
