Two people are being sued over the February 17 collision that killed 40-year-old Surrey resident Sukhwinder Mangat, and her 16-year-old son Robbie Mangat in Newton.
A BC Supreme Court statement of claim has been filed by Mohinder Singh Mangat, the husband of Sukhwinder and father of Robbie.
It names Zoheb Ifraz Nasim and Abdul Nasim, both Surrey residents, as the driver and owner of the gold Infiniti SUV that slammed into the passenger side of the small black Pontiac sedan occupied by the Mangats just before 12 noon at the intersection of 132 Street and 60 Avenue.
The lawsuit alleges negligence, saying Zoheb Ifraz Nasim was driving contrary to the restrictions on his driver's licence, that he was speeding when he ran a red light, and that the vehicle was defective and that Nasim failed to use the SUV horn to warn the Mangats.
It says Abdul Nasim is responsible for allowing Zoheb to drive the SUV and for allegedly failing to properly maintain it.
None of the claims have been proven in court, and the Nasims have not yet filed a statement of defence.
The fatal crash occurred just four blocks from the Mangat family home.
Police said the Pontiac was heading south on 132 Street when it arrived at the four-way stop.
As the smaller car was making a left turn, it was broadsided by the larger SUV, which was traveling north.
The force of the collision knocked the two vehicles into the front yard of the Berea Baptist Church.
The son was declared dead at the scene, the mother died later.
At the time, Surrey RCMP said a 17-year-old was driving the SUV, which was registered to his parents.
