Kitimat man jailed over tax returns

Kitimat resident, Brian McCabe, was found guilty on April 24, 2008, in Kitimat Provincial Court for failure to comply with a February 2006 Court Order to file his personal income tax returns. McCabe was sentenced to 30 days in jail and has 90 days to file his personal tax returns, along with Statement of income and expenses, for tax years 2000, 2001, 2002 and 2003.

When people are convicted of failing to file tax returns, in addition to any fines imposed by the courts, they must still file the returns and pay the full amount of taxes owing, plus interest, as well as any civil penalties that may be assessed by the Canada Revenue Agency (CRA).

In 2007, 16 people were convicted in the Northern B.C. and Yukon area for failing to file either personal or corporate tax returns. This resulted in fines of $72,000 and eight days in jail. Also during this period, enforcement officers at the Northern BC and Yukon Tax Services Office obtained 4,256 late-filed tax returns. The additional taxes, penalties and interest from those returns totaled $14,630,075.

Canada Revenue Agency Commissioner William V. Baker said, "With the punishment levied today, the courts have issued notice to Canadians that failure to file tax returns is taken seriously and has significant consequences."
